ORDERS

AT&T shall apply for a cable franchise pursuant to Conn. Gen. Stat. §16-331 et. seq. no later than December 31, 2007.

AT&T may continue to serve its existing video subscribers until such time as the Department rules upon an application for cable franchise submitted pursuant to Order No. 1.

AT&T shall cease and desist from marketing to or contracting with any additional customers for its cable programming operations in the State of Connecticut until such time as AT&T has obtained a duly authorized cable franchise pursuant to Conn. Gen. Stat. §16-331 et. seq.

Despite the presence of a new Connecticut law setting up statewide video franchises for new entrants, the Connecticut Department of Public Utility Control (DPUC) yesterday rejected AT&T's bid for such a license. AT&T, which refuses to take out traditional video franchises with local communities (as cable companies have done across the country) is now threatening to pull its U-Verse out of Connecticut, fire 300 Connecticut workers, and redirect over $300 million of investment money to nearby states.

The attorney general in Connecticut is not backing down in his quest to make sure AT&T’s U-verse is subject to the same requirements as cable TV operations. Attorney General Richard Blumenthal’s latest volley is a public request that AT&T’s franchise application be rejected, which seems counterintuitive on its face. Blumenthal fought to make AT&T obtain a franchise license from the Connecticut Department of Public Utility Control in August. The PUC was all about letting AT&T slide, but a federal judge suggested otherwise.

ATT franchise issue not yet resolved

State regulators will continue to review AT&T's application to provide Internet TV despite a federal court ruling Tuesday saying the service should be regulated as a cable franchise.

Beryl Lyons, a Department of Public Utility Control spokeswoman, said the agency is aware of Tuesday's court ruling but, because of a new state law that governs video service, the issue of licensing AT&T as a cable franchise is moot.

AT&T lost some ground yesterday in its ongoing battle with cable and satellite television.

The telecommunications giant's efforts to compete through its fiber-optic U-verse, available in several Fairfield County communities, were dealt a setback by a federal judge in New Haven.
